The U.S. Citizenship and Immigration Services ("USCIS") has announced that the new Form I-9 will be released on November 22, 2016. For the time period November 22, 2016 through January 21, 2017, either the previous version of the Form I-9 (dated 03/08/13) or the new version of the Form I-9 (dated 11/22/16) can be used. Effective January 22, 2017, the new version will be the only version that can be used and all previous versions will be invalid. Although the new version has not been released yet, we know that the new Form I-9 will contain many "smart" features when completed online in pdf format which were designed to help reduce errors. Some of these "smart" features include drop down functionality for filling in lists and selecting dates, prompts on certain fields to ensure information is entered correctly and embedded instructions for completing each field. One of the primary goals of the new Form I-9 was to help employers reduce errors and ease the process of completing the work-verification form on their office computer. However, the new "smart" features do not constitute an electronic Form I-9. So it is important for employers to understand what the responsibilities are if the Form I-9 is completed on a computer. The new Form I-9 is also expected to include some structural changes and new fields. Employers should make sure that its staff responsible for completing the Form I-9 are properly trained on the new Form I-9 and I-9 Policies and Procedures should be reviewed and updated.
